Is this gambling? Can I get in trouble?

No. Because there's no entry fee, there's no wager, which means it's not gambling under U.S. law. It's a free-entry contest of skill, legal in all 50 states, the same legal category as a bracket challenge or sweepstakes.

How often do pick'em contests run?

Pickett's Pick'em is launching with the PGA Championship, with the U.S. Open and Open Championship next on the calendar. It is currently running for all majors - we're working toward eventually expanding to every event and playoff stop on the PGA Tour. You can play one or all of them.

Pickett's Pick'em is a free-entry skill-based prize contest. No purchase necessary. Open to legal U.S. residents 18 years of age or older (and, for select contests, legal residents of any additional countries identified on that contest's entry page). Operator decisions are final. Void where prohibited or restricted by law. Not affiliated with the PGA Tour, PGA of America, Augusta National Golf Club, the R&A, USGA, or any tournament organizing body or golf federation. The PGA Championship is the founding event; future contests may be funded by event sponsors as those partnerships come online. Multiple entries, identity misrepresentation, or providing an email you do not own are grounds for disqualification. See Terms of Entry below for full eligibility, prize-claim, and tax-reporting requirements.

Terms of Entry

By submitting your picks, you confirm and agree to the following:

Identity. You are the person named in the entry, and you own and control the email address you submitted. Entries submitted under another person's name, with an email you do not own, or with falsified information are invalid and will be disqualified, and any associated prize forfeited.
One entry per person. You have not submitted, and will not submit, another entry for this contest under any other name, email, alias, household member, or account. Multiple entries by or on behalf of the same person disqualify all entries from that person.
Eligibility. You are at least 18 years of age and a legal resident of the United States, or of another country expressly identified as eligible on the entry page or official rules supplement for the specific contest you are entering (for example, the 2026 U.S. Open contest is open to legal residents of the United States, Canada (excluding Quebec), the United Kingdom, Ireland, Germany, and Sweden). Entrants residing outside the United States are responsible for ensuring that their participation is lawful in their place of residence, and any taxes owed on a prize in the entrant's country of residence are the entrant's sole responsibility. For entrants in Canada: the number and value of available prizes are as published on the contest's entry page, and chances of winning are determined by entrants' skill in selecting golfers rather than by random draw.
No purchase necessary. Entry is free. No purchase, payment, donation, wager, or other consideration is required to enter, to participate, or to be eligible to receive a prize.
Pick lock and pick changes. Picks may be edited only via the secure edit link delivered to the email address you submitted with your entry, and only up until the pick-lock deadline. The secure edit link is the sole mechanism by which you may modify, withdraw, replace, or substitute any of your picks.
- (a) Operator sets the pick-lock time at sole discretion. The pick-lock deadline is set by the operator in the operator's sole discretion, and the operator is not obligated to publish, pre-announce, post on the entry page, email, or otherwise communicate the exact pick-lock time to entrants in advance. The operator's posting (or omission) of any specific pick-lock time, whether on the entry page, in an email, on social media, or elsewhere, is informational only and does not constitute a binding commitment by the operator to lock picks at that exact time. The operator may lock picks at any moment within the window defined in clause 5(b), and that lock event is the binding pick-lock for the contest.
- (b) Pick-lock window. Notwithstanding the operator's discretion in clause 5(a), the operator will not lock picks earlier than 11:59 PM Pacific Time on the calendar day immediately preceding the official first day of the tournament's first round, and will not lock picks later than the first official tee time of the tournament's first round. Within that window - which begins at 11:59 PM Pacific Time the day before the first round and closes at the first official tee time - the operator may lock picks at any time the operator considers appropriate.
- (c) Reason for operator discretion. The operator's discretion under clause 5(a) and the corresponding window in clause 5(b) exist so the operator can, among other things, perform application cutover, data validation, scoring-system readiness checks, abuse-defense review, last-minute field-update reconciliation, and other operational integrity steps the operator determines (in its good-faith judgment) are necessary or advisable before the tournament begins. Entrants are not entitled to any particular pick-lock time, advance notice of the pick-lock time, or any compensation, refund (entry is free), or other remedy in connection with the operator's choice of pick-lock time within the clause 5(b) window.
- (d) Picks final after lock. After picks lock, your picks are final and cannot be changed for any reason, by any method, by any party, including (without limitation) by emailing the operator, replying to a notification, posting on social media, or any other communication. No correspondence, screenshot, support thread, customer-service exchange, or other communication creates a right to modify a locked entry, and the operator has no obligation to entertain such requests. The right to edit picks is limited to the pre-lock window and ends automatically the moment the operator locks picks under clauses 5(a) and 5(b).
Field updates and tier integrity. The operator reserves the right to add or remove golfers from the entry form's tier list throughout the entry period, including after entries have begun, to reflect late commitments, withdrawals, injuries, or other changes to the official tournament field. However, once a golfer has been published in a specific tier on the entry form, the operator will not move that golfer to a different tier for the remainder of that contest. Tier assignments at the time the entry form was published are honored for the duration of the contest. If a golfer you selected is removed from the field before picks lock, you may edit your entry via the secure link in your confirmation email to select a different golfer from the same tier. After picks lock, picks are final regardless of any change to the field, and the operator has no obligation to notify entrants of golfer injuries, withdrawals, disqualifications, or other status changes before or during the tournament. If a golfer you selected withdraws, is disqualified, becomes injured, or is otherwise removed from the tournament after picks lock, your pick stands; that golfer's stroke total is determined by the official tournament organizing body's published handling for that situation (typically a non-scoring outcome). Entrants are not entitled to a replacement pick, refund, prize adjustment, or any other form of compensation in connection with any post-lock golfer status change, regardless of the cause.
Prize-claim window. If you finish in a paid position, a prize-notification email will be sent to the address you submitted. To receive your prize you must respond with valid, complete payment information within 30 days of the prize-notification email. Unclaimed or unverifiable prizes may be forfeited and redistributed at the operator's sole discretion.
Tax reporting and identity verification. If your prize earnings from this contest total $600 or more in any calendar year, you must provide a completed IRS Form W-9 (or, for non-U.S. residents, an applicable IRS Form W-8BEN or equivalent) before any payout will be issued, in accordance with U.S. tax-reporting requirements. The operator may also require government-issued identity verification before issuing any prize. Unprovided, invalid, or expired tax or identity information will delay or forfeit payment. You are solely responsible for all federal, state, and local taxes owed on prizes received.
Operator authority, pre-payout eligibility review, and forfeiture for breach. The operator reserves the right to disqualify any entrant for cheating, fraud, identity misrepresentation, multiple entries (including entries submitted by or on behalf of the same person under different names, email addresses, household members, or payment handles), manipulation of the entry or scoring system, or any conduct the operator determines violates these Terms or the integrity of the contest. Before issuing any prize, operator reserves the right to review the prospective recipient's compliance with these Terms, including by verifying identity (clause 1), one-entry-per-person compliance (clause 2), eligibility (clause 3), and the absence of any other breach. Operator may require, as a condition of payout, government-issued identity verification, a signed eligibility affidavit, a completed IRS Form W-9 where applicable under clause 8, and any other documentation operator reasonably determines is necessary to confirm compliance. Any breach of these Terms by an entrant - including without limitation identity misrepresentation, falsification of entry information, the submission of more than one entry by the same person under any name or identifier, manipulation of the entry or scoring system, or violation of any other clause - automatically nullifies that entrant's eligibility to receive any prize and forfeits any prize otherwise payable to that entrant, regardless of the entrant's finishing position. Operator's good-faith determination that a breach has occurred is final and binding under this clause and clause 17 (dispute resolution). Forfeited prizes may, at operator's sole discretion, be redistributed to the next eligible entrant(s) under the official scoring methodology, retained by operator, or otherwise resolved consistent with the integrity of the contest. Operator decisions on scoring, ties, disqualifications, prize amounts, and prize distribution are final and binding.
Free-entry contest of skill; per-contest state exclusions. This contest is offered as a free-entry contest of skill, not a wager or game of chance. Eligibility to receive prizes is limited to jurisdictions in which free-entry skill contests are legal. Void where prohibited or restricted by law. Operator reserves the right to exclude residents of specific U.S. states or other jurisdictions from prize eligibility for any individual contest, where operator determines (in its sole discretion) that local law, registration requirements, surety-bond requirements, or other regulatory considerations make participation impractical or non-compliant. Any such per-contest state exclusions will be posted on the contest's entry page or in an official rules supplement before that contest's pick-lock deadline. An entrant who is excluded under this clause may still submit picks for tracking purposes but is ineligible to receive any prize for that contest.
Communications consent. By entering, you consent to receive contest-related communications from Pickett's Pick'em at the email address you submitted, including entry confirmation, the secure edit link, scoring and round recaps, leader and result notifications, and prize-related correspondence. You may unsubscribe from non-essential communications at any time; certain communications (entry confirmation, prize notification, tax-form correspondence) are required to administer the contest and cannot be opted out of while you are an active or paid entrant. If, at any time in the future, operator offers SMS / text-message communications and you separately and expressly opt in by providing a mobile number and affirmatively consenting (for example, via a checkbox or keyword reply), you may receive contest-related text messages at that number; standard message and data rates may apply, and you may opt out of SMS communications at any time by replying STOP. Operator does not send contest-related text messages without separate, express written consent under the federal Telephone Consumer Protection Act (TCPA) and analogous state laws.
Limitation of liability and technical disclaimers. To the fullest extent permitted by law, Pickett's Pick'em, its operator, employees, and event sponsors are not liable for, and entry into the contest constitutes acknowledgment and acceptance of the risk of, any of the following:
- Site or service downtime, server outages, hosting interruptions, DNS or CDN failures, or any unavailability of the website, the entry form, the leaderboard, notifications, edit links, or any other feature of the contest at any point before, during, or after a tournament;
- Technical malfunctions, software bugs, browser or device incompatibility, JavaScript errors, data corruption, cache issues, or any other defect that affects entry submission, picks editing, scoring calculation, payout calculation, or display of any result;
- Errors, delays, omissions, or inaccuracies in live or projected standings, leaderboard positions, projected payouts, position-change indicators, top-of-tier indicators, cut-line projections, "best 4 of 6" calculations, tournament recaps, or any pick'em-wide statistic shown on the site during or after a tournament;
- Incorrect, missing, duplicate, late, or otherwise inaccurate notifications, live-feed events, recap emails, edit-link emails, prize-notification emails, or any other in-app or transactional communication;
- Errors, interruptions, latency, or inaccuracies in any third-party data feed on which the live experience depends, including but not limited to ESPN, third-party golf statistics providers, the PGA Tour, or any other golf-data provider, scoring service, statistical provider, or tournament organizing body;
- Any other unforeseen, unanticipated, or unpreventable technical, network, or human error that affects the live presentation of the contest, the accuracy of any displayed information, or the timeliness of any communication.
The operator may suspend, modify, restart, or cancel the contest in the event of fraud, abuse, a technical failure that materially compromises the integrity of the contest, an act of God, or any other cause beyond the operator's reasonable control. No such occurrence creates a right to a refund (entry is free) or to any other compensation beyond what the official scoring methodology produces under clause 13.
Scoring source of truth. Final standings, paid positions, and prize amounts are determined solely by the official "Best 4 of 6" scoring methodology defined below, applied to the official final results published by the relevant tournament organizing body.
- Step 1 - Best 4 of 6. Each entrant submits six golfer picks. After the tournament concludes, each entrant's six individual golfer stroke totals (relative to par, per the official tournament organizing body's final results) are sorted; the lowest four are summed. The remaining two scores are dropped.
- Step 2 - Final entrant score. The entrant's final score equals the sum of the lowest four golfer stroke totals from Step 1. Lower scores rank higher.
- Step 3 - First-place tiebreaker. If two or more entrants tie for the lowest final score, the tie for first place only is resolved by the following sequence:
  - Primary tiebreaker - has any tournament leader/winner as a pick. Among the tied entrants, an entrant whose six picks include any golfer currently at solo 1st place or in a tie for 1st place on the official tournament leaderboard wins over an entrant whose picks include no such golfer. "Currently" means the state of the official leaderboard at the moment the tiebreaker is evaluated; for the final standings, this is the official final tournament results, meaning the actual tournament winner (or co-winners in the event of a tournament-level tie) is the golfer that satisfies this tiebreaker.
  - Secondary tiebreaker - most cuts made. If still tied after the primary tiebreaker, the entrant whose six picks include the greatest number of golfers who made the official tournament cut wins. Higher cuts-made count wins.
  - Tertiary tiebreaker - tier-by-tier from Tier 6 down. If still tied after the primary and secondary tiebreakers, the entrant with the best (lowest stroke total, relative to par) Tier 6 golfer score wins. If still tied, the same comparison is applied in turn to Tier 5, then Tier 4, Tier 3, Tier 2, and finally Tier 1, until the tie is broken.
  - Identical-picks fallback. If two or more entrants remain tied for first place after all three tiebreakers are exhausted because they submitted identical golfer picks across all six tiers, those entrants will split the first-place payout equally. This is a rare edge case and only applies when picks are literally identical, tier-for-tier.
  The tiebreaker resolves a single first-place winner unless the identical-picks fallback applies. Entrants who lose the first-place tiebreaker remain tied for second place. This tiebreaker procedure applies only to ties at first place; ties at any other position stand as scored and are paid per Step 4.
- Step 4 - Payout calculation for tied positions. When two or more entrants are tied at any paid position other than first (for example, three entrants tied for 5th, or two entrants tied for 2nd after the first-place tiebreaker has resolved a 1st-place winner), the payout for the tied entrants is calculated using a combined-position split: the published payout amounts for each of the positions the tied entrants collectively occupy are summed, and the total is divided equally among the tied entrants. For example, three entrants tied for 5th place each receive one-third of the combined 5th + 6th + 7th place payouts; two entrants tied for 9th each receive one-half of the combined 9th + 10th place payouts. The same calculation applies to entrants tied for 2nd after a first-place tiebreaker resolves the 1st-place winner.
The official scoring methodology, applied to the official final results published by the relevant tournament organizing body, governs all final outcomes. Any standings, projected payouts, leaderboard positions, position-change indicators, notifications, recap emails, live-feed events, or other data displayed on the live site or in pick'em communications during a tournament are provisional and informational only; they may differ from the official final calculation for any of the technical reasons described in clause 12. In the event of any conflict between data displayed during a tournament and the official methodology applied to the official tournament results, the official methodology controls. Final standings and payouts are determined by the operator's application of the official methodology after the tournament concludes and become binding when the operator publishes them. Earlier displayed standings or payout amounts do not create any entitlement to a position, prize, or amount that the official methodology does not produce.
Indemnification. You agree to defend, indemnify, and hold harmless Pickett's Pick'em, its operator (Hunter Thomas LLC), its employees, contractors, affiliates, and (where applicable to a given contest) any event sponsor of that contest, from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your entry submission or participation in the contest; (b) your breach of any provision of these Terms; (c) your violation of any applicable law or any third party's rights, including without limitation rights of publicity, privacy, or intellectual property; or (d) any false, misleading, or fraudulent information you provide. Operator reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with operator's defense at your expense.
Right of publicity. By entering the contest and (where applicable) by accepting a prize, you grant Pickett's Pick'em, its operator, and (where applicable to a given contest) the relevant event sponsor of that contest a perpetual, non-exclusive, royalty-free, worldwide right to use your first name, last initial, city, state, golfer picks, final score, finishing position, and prize amount (where applicable) for promotional, advertising, marketing, and editorial purposes connected to the contest, in any medium now known or later developed, without further notice, compensation, or consent. Photographic likeness, video, voice recordings, and biographical information beyond what is listed above will be used only with your separate written consent. Nothing in this paragraph requires operator or any sponsor to use any such information.
Funding source and prize-purse contingency. Each contest is either (i) operator-funded, meaning the prize purse is funded directly by Pickett's Pick'em / Hunter Thomas LLC, or (ii) sponsor-funded, meaning the prize purse is funded in whole or in part by one or more event sponsors. The funding source for each contest is identified on the contest's entry page or in an official rules supplement.
- (a) Operator-funded contests. For an operator-funded contest, the published prize purse and payout structure represent operator's binding funding commitment for that contest, subject only to clauses 12 (limitation of liability and technical disclaimers), 13 (scoring source of truth), 17 (dispute resolution), and 18 (force majeure). Operator's failure or refusal to pay a published prize for an operator-funded contest is not excused by ordinary business circumstances; only the limited circumstances enumerated in clauses 12, 13, 17, and 18 may modify operator's payout obligation.
- (b) Sponsor-funded contests. For a sponsor-funded contest, prize availability and amounts are contingent on the relevant event sponsor's performance of its funding obligations to Pickett's Pick'em. If sponsor funding becomes unavailable, reduced, or delayed for any reason before prizes are paid - including without limitation sponsor insolvency, payment default, withdrawal of sponsorship, breach of sponsor agreement, or any other failure of sponsor performance - operator may, at its sole discretion, reduce the prize purse, modify the prize structure, delay prize payouts, substitute prizes of equal or lesser value, or cancel the contest in whole or in part. Operator's sole obligation in any such event is to provide reasonable notice to affected entrants. No entrant is entitled to any prize, refund, replacement prize, or other compensation in the event of sponsor non-performance for a sponsor-funded contest, beyond what operator chooses in its discretion to provide. This clause 16(b) applies only to sponsor-funded contests and has no application to operator-funded contests.
Dispute resolution, arbitration, and governing law. PLEASE READ CAREFULLY - THIS PROVISION AFFECTS YOUR LEGAL RIGHTS.
- (a) Informal resolution first. Before filing any formal claim, the parties agree to attempt to resolve the dispute informally by contacting andrew@pickettspickem.com; the parties will negotiate in good faith for at least 30 days before pursuing arbitration.
- (b) Mandatory binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms, the contest, or your relationship with Pickett's Pick'em that is not resolved informally shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Washington County, Oregon, or, at the entrant's option, by telephone or video conference. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
- (c) Class action waiver. YOU AND OPERATOR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one entrant's claims and may not preside over any form of class or representative proceeding. If a court decides this class-action waiver is unenforceable as to a particular claim, that claim (and only that claim) shall be severed from arbitration and brought in court.
- (d) Carve-outs. Notwithstanding the above, either party may: (i) bring an individual action in small-claims court for any claim within that court's jurisdiction; or (ii) seek injunctive or other equitable relief in court for actual or threatened infringement of intellectual-property rights or breach of confidentiality.
- (e) Governing law and venue. These Terms and any dispute arising out of them are governed by the laws of the State of Oregon, without regard to conflict-of-laws principles. To the extent any matter is not subject to arbitration, the parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Washington County, Oregon.
- (f) Time limit on claims. To the maximum extent permitted by applicable law, any claim arising out of these Terms or the contest must be brought within one (1) year of the date the claim arose, or be forever barred. If the law of the entrant's state of residence prohibits contractual shortening of the limitations period below a longer statutory minimum, the longer statutory minimum applies.
- (g) Right to opt out of binding arbitration and class-action waiver. You may opt out of the binding-arbitration provision in clause 17(b) and the class-action waiver in clause 17(c) by sending written notice of opt-out to andrew@pickettspickem.com within thirty (30) days of your first entry into any Pickett's Pick'em contest. The notice must include your full name, the email address you used to enter, and a clear statement that you are opting out of arbitration and the class-action waiver. Opting out does not affect any other provision of these Terms, including the governing-law and venue provision in clause 17(e), and is your sole and exclusive method of opting out of arbitration and the class-action waiver. Failure to send a timely opt-out notice waives your right to do so.
Miscellaneous.
- Force majeure. Operator is not liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including without limitation acts of God, weather events, natural disasters, pandemic or public-health emergencies, war, terrorism, civil unrest, government action, court order, labor disputes, internet outages, third-party service provider failures, or sponsor non-performance. If the underlying tournament is canceled, postponed, suspended, shortened, or otherwise materially modified by the tournament organizing body or by any force majeure event, operator may at its discretion reschedule the contest, modify the scoring methodology to fairly reflect a shortened or modified tournament, cancel the contest in whole or in part with notice, or take any other reasonable action to fairly conclude the contest. No entrant is entitled to any prize, refund, or compensation in connection with a canceled, postponed, or modified contest beyond what operator chooses to provide.
- Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, the remaining provisions shall continue in full force and effect, and the unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving the parties' original intent.
- Entire agreement. These Terms, together with the Privacy Policy and any other policies expressly referenced, constitute the entire agreement between you and operator regarding the contest and supersede all prior or contemporaneous communications, representations, or agreements (oral or written) on the same subject. No statement, advertisement, social-media post, or marketing communication outside these Terms shall create any obligation on the operator beyond what these Terms expressly provide.
- No waiver. Operator's failure to enforce any provision of these Terms is not a waiver of operator's right to enforce that or any other provision later.
- Assignment. Operator may assign these Terms or any of its rights or obligations under them at any time, with or without notice. You may not assign these Terms without operator's prior written consent.
- Headings. Clause headings are for convenience only and do not affect interpretation of these Terms.
Side games and ancillary prizes. In addition to the primary competition payout determined by the official scoring methodology in clause 13 ("Scoring source of truth"), operator may, in operator's sole and absolute discretion, fund and award one or more side-game prizes ("ancillary prizes") in connection with any contest. Side games are separate from the primary competition payout and are governed solely by this clause.
- (a) Operator discretion over existence, structure, and amount. Operator has sole and absolute discretion over: whether any side game runs at all for a given contest; how many side games run; what each side game measures or rewards (for example, "biggest mover," "biggest single-round jump," or any other in-tournament metric operator chooses, with the right to invent, retire, or modify any such measurement at any time); the timing and frequency of side-game determinations within or after the tournament; the dollar amount funded for each side game; the method by which side-game winners are identified; whether side-game winners are determined automatically by the scoring system, manually by operator, or by some combination; and whether unannounced side games are introduced before, during, or after the tournament. Side-game inclusion in any contest is entirely optional from operator's perspective; operator is not obligated to run any side game in any contest, even if a side game has been mentioned, advertised, run, or implied to exist in a prior contest.
- (b) No advance disclosure required. Operator is not obligated to publish, pre-announce, post on the entry page, list in the FAQ, email, communicate via in-app notification, or otherwise disclose to entrants in advance: which side games (if any) will run for a given contest; how each side game will be measured; the dollar amount allocated to each side game; the timing of side-game determinations; or any other detail of side-game structure. Some, all, or none of any contest's side games may be announced in advance; some, all, or none may run as surprise prizes determined and announced after the fact. The operator's omission of side-game details from any pre-contest communication does not waive operator's discretion to introduce, modify, retract, or substitute side games at any time.
- (c) No entitlement. No entrant is entitled to any side-game prize, to any specific side-game structure, to any minimum total side-game prize purse, or to any pre-tournament disclosure of side-game terms. Operator's good-faith determination of side-game results - including which entrant(s) qualify, how a measurement applies, and how ties within a side game are resolved - is final and binding under this clause and clause 17 ("Dispute resolution"). Forfeited or unclaimed side-game prizes may, at operator's sole discretion, be redistributed to other entrants, returned to operator, or otherwise resolved consistent with the integrity of the contest.
- (d) Aggregate prize representations. Where operator publishes an aggregate prize figure for a contest (for example, "$1,000 in cash prizes," "$1K in prize money," or "total prize purse $1,000"), that figure represents the combined total of the primary competition payout and any side-game prize purse operator has elected to allocate for that contest. The aggregate figure is operator's binding commitment to fund the stated total amount across the primary competition and side games combined; the allocation of that total between primary competition and side games, the specific side games operator chooses to run, and all other side-game terms remain at operator's sole discretion under clauses 19(a) through 19(c). For the avoidance of doubt: operator's commitment is to the aggregate dollar figure, not to any specific allocation between primary and ancillary prizes.
- (e) Side-game prizes follow primary-prize rules where applicable. Identity verification (clause 1), one-entry-per-person (clause 2), eligibility (clause 3), prize-claim window (clause 7), tax reporting and identity verification (clause 8), forfeiture for breach (clause 9), per-contest state exclusions (clause 10), publicity rights (clause 15), and indemnification (clause 14) all apply equally to side-game prizes and side-game winners. The limitation-of-liability and dispute-resolution provisions in clauses 12, 17, and 18 (force majeure, severability, and the rest) also apply.
- (f) Default tiebreaker fallback for side games. Where a side game’s own stated tiebreakers (if any) do not resolve a single winner, or where a side game has no stated tiebreaker, the tie is broken by the same tier-by-tier sequence from Tier 6 down used for the first-place tiebreaker in clause 13 (“Scoring source of truth”): the tied entrant with the best (lowest stroke total relative to par) Tier 6 golfer score wins; if still tied, the same comparison is applied in turn to Tier 5, then Tier 4, Tier 3, Tier 2, and finally Tier 1, until the tie is broken. If two or more entrants remain tied after this sequence because their picks are identical tier-for-tier, the affected side-game prize is split equally among them. This default fallback applies to every side game unless operator specifies a different tiebreaker for a particular side game, and is in addition to operator’s discretion over tie resolution under clause 14(c).

Pickett's Pick'em is not affiliated with, endorsed by, or sponsored by the PGA Tour, PGA of America, Augusta National Golf Club, the R&A, the United States Golf Association, or any other tournament organizing body or golf federation. This Privacy Policy is incorporated into, and forms part of, the Pickett's Pick'em Terms of Entry. Capitalized terms used but not defined here have the meanings given in the Terms of Entry. This site is operated by Hunter Thomas LLC and is intended primarily for residents of the United States. Where a specific contest's entry page identifies additional eligible countries (for example, Canada, the United Kingdom, Ireland, Germany, and Sweden for the 2026 U.S. Open contest), residents of those countries may submit the information needed to enter that contest; all other visitors from outside the United States should not provide personal information through this site.

Information we collect. When you enter a contest, we collect the information you submit on the entry form: your name, email address, your six golfer picks, optional referral source, and optional comments. When you submit any form on this site we also collect a per-form timestamp and a privacy-preserving browser fingerprint (used to detect and prevent automated abuse, not to track you across the web). When you visit the site we collect aggregated traffic data via Google Analytics 4 (page views, country / region, device class, session duration). With Google Signals enabled, Google Analytics may also report aggregated demographic data (broad age range, gender), interest categories (in-market and affinity audiences), and cross-device session activity for visitors who are signed into Google with personalized ads enabled in their Google account. All analytics data is reported to us in aggregate and is not linked to the name or email you submit to enter the contest. You can opt out of personalized ads, and therefore the enhanced GA4 data collection, at any time through your Google Ads Settings at myaccount.google.com/ads, or by installing the Google Analytics Opt-out Browser Add-on.

How we use it. We use the information you submit to:

Administer the contest (process your entry, calculate standings, distribute prizes);
Send contest communications (entry confirmation, the secure edit link, the tournament-start "Verify your roster" email, round-recap emails, leader and result notifications, prize-related correspondence);
Track aggregate click-through on tokenized links in those emails (the "see live standings" links, edit-link, etc.) so we can measure whether the round-update emails are useful and improve them over time. We record the click timestamp, the link source, and a salted hash of the request IP for diagnostic and audit purposes only; we do not use this information for cross-site advertising or for any purpose other than administering the contest;
Communicate with you about future Pickett's Pick'em events you may be interested in (you may unsubscribe from these non-essential communications at any time);
Detect and prevent fraud and abuse of the entry system; and
Comply with our tax-reporting, record-keeping, and other legal obligations.

Cookies and similar technologies. The site uses cookies and similar technologies for analytics (Google Analytics 4) and bot / fraud prevention (Cloudflare Turnstile, FingerprintJS). These technologies may set first- or third-party cookies, store identifiers in your browser's local storage, or collect technical device and browser information for the purposes described in this policy. We do not use these technologies for cross-site advertising. You can control cookies through your browser settings; disabling cookies may limit some site functionality.

Service providers we share data with. We do not sell, rent, or trade your personal information. We share data only with the third-party service providers we use to operate the contest, and only to the extent necessary for them to perform services for us. Those providers currently include: Netlify (form submission and site hosting), Google (Google Analytics 4 traffic analytics), Cloudflare (Turnstile bot prevention), FingerprintJS (privacy-preserving browser fingerprint for fraud prevention), and Resend or comparable transactional email providers (delivery and click-tracking of confirmation, edit-link, verify-roster, recap, and prize-notification emails; click-tracking is used to measure aggregate audience-engagement metrics for the round-update emails). For sponsor-funded contests we may share aggregate, anonymized audience metrics (such as total entrant count, geographic distribution, and engagement) with the relevant event sponsor; we will not share your name, email, or any individually identifying information with any sponsor unless you explicitly opt in to a specific sponsor offer.

Data retention. We retain entry data for the duration required to administer the contest, distribute prizes, comply with tax-reporting and record-keeping obligations, and prevent fraud. As a working baseline: prize-winner records (including W-9 forms and 1099-MISC documentation) are retained for at least seven (7) years after the contest concludes, consistent with IRS record-keeping guidance; non-winner entry data (name, email, picks) is retained for up to three (3) years for fraud-prevention pattern analysis, after which it is deleted or de-identified; aggregate analytics data has no fixed deletion schedule because it is not personally identifiable. You may request deletion of your information at any time by emailing andrew@pickettspickem.com; deletion requests for active or paid entrants may be limited or delayed by these record-keeping and tax-reporting obligations.

Your rights generally. Subject to applicable law and to the data-retention obligations described above, you may request that we (i) confirm whether we hold information about you, (ii) provide a copy of that information, (iii) correct inaccurate information, (iv) delete information no longer necessary to administer a contest, or (v) restrict certain uses of that information. Send any such request to andrew@pickettspickem.com; we will respond within the time period required by applicable law.

California residents (CCPA / CPRA). If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act, gives you specific rights regarding your personal information, including the right to know what personal information we collect, the right to request deletion or correction, the right to opt out of "sale" or "sharing" of personal information (including for cross-context behavioral advertising), the right to limit use of sensitive personal information, and the right not to be discriminated against for exercising these rights. We do not sell your personal information for money. Because we use Google Analytics 4 with Google Signals, our use of that service may constitute "sharing" under the CPRA's expanded definition. To opt out of any such sharing, you may (i) install the Google Analytics Opt-out Browser Add-on linked above, (ii) disable personalized ads in your Google account, or (iii) email andrew@pickettspickem.com with the subject line "Do Not Sell or Share My Personal Information"; we will honor that request for the email address from which it is sent. Authorized agents may submit requests on your behalf with reasonable verification.

Other state privacy rights. Residents of states with comprehensive consumer privacy laws (including, as of the last-updated date below, California, Colorado, Connecticut, Oregon, Texas, Utah, and Virginia) have rights similar to those described in the California section, subject to the specific provisions of each state's law. Entrants in Sweden and the EU/EEA (GDPR). For contests whose entry page identifies a country in the European Economic Area as eligible (for example, Sweden, Ireland, and Germany for the 2026 U.S. Open contest), Hunter Thomas LLC is the "controller" of the personal information you submit, and the EU General Data Protection Regulation (GDPR) gives you additional rights. Our legal bases for processing are: performance of a contract (Article 6(1)(b)) for administering your entry, calculating standings, sending the contest communications required to run the contest, and delivering prizes; legitimate interests (Article 6(1)(f)) for fraud prevention and abuse detection; and consent (Article 6(1)(a)) for non-essential communications about future events, which you may withdraw at any time. You have the right to access, rectify, erase, restrict, or object to our processing of your personal information, the right to data portability, and the right to lodge a complaint with your local supervisory authority (in Sweden, the Swedish Authority for Privacy Protection, IMY, imy.se). Your information is processed and stored on servers located in the United States; where a service provider does not participate in the EU-U.S. Data Privacy Framework, we rely on your explicit consent given at entry (Article 49(1)(a)) for this occasional, non-repetitive transfer. Entrants in the United Kingdom have equivalent rights under the UK GDPR and may lodge complaints with the UK Information Commissioner's Office (ICO). To exercise any of these rights, email andrew@pickettspickem.com.

Children. Pickett's Pick'em contests are open only to entrants 18 years of age or older, and this site is not directed at minors. We do not knowingly collect personal information from minors of any age. Consistent with the federal Children's Online Privacy Protection Act (COPPA), if we learn that we have collected personal information from a child under 13, we will delete that information promptly. If you believe a minor has provided information through this site, contact andrew@pickettspickem.com.

Data-breach notification. If we become aware of a security incident affecting your personal information, we will notify affected entrants and any regulator required to be notified, in each case in accordance with applicable federal and state breach-notification laws and, for EU/EEA entrants, the breach-notification requirements of the GDPR.

Changes to this policy. We may update this Privacy Policy from time to time. The version in effect at the time of your entry governs that entry; material changes will be reflected by an updated last-updated date below and, where required by law, by additional notice.
